Terms and Conditions
- Upon receiving your orders, please inspect and ensure all your items are correct.
- For any wrong or incomplete orders, please notify us within 2 hours upon receiving your items. All items should be unconsumed and in its original state for a refund or exchange of product, whichever FCSB deem fit.
- For defective items, such as items which have lost their original textures and/or appearances or products which contain non-edible elements, please inform us within 2 hours upon receiving the items. Please provide us with the necessary proof of defect for us to investigate further. All items should be unconsumed and in its original state or partially consumed (in the state that such defect was discovered) for a refund or exchange of product, whichever FCSB deem fit.
- Any claims of defective items received by us after 1 day, will not be entertained.
- A second attempt for delivery will be made only upon request and additional delivery fees will be charged separately. The fee will be based on the return trip from our location to the recipient address.
- FCSB shall not be liable for claims under the following circumstances: - (a) The recipient is not present at the address given at the time the delivery was requested to take place.
- FCSB shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond FCSB reasonable control.
- These Terms and Conditions and a Contract (and all non-Contractual obligations arising out of or connected to them) shall be governed and construed in accordance with Malaysian Law. Both parties hereby submit to the non-exclusive jurisdiction of the Malaysian Courts.
Order Acceptance Policy
All orders and subscription requests received via FAR COFFEE SDN. BHD. WOS are subject to acceptance by FAR COFFEE SDN. BHD. (“FCSB”) and by any of its personnel. Payments shall be made to FCSB via DuitNow QR, credit cards or through our facial recognition payment systems. We reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will offer store credit of equal value to your paid amount. All orders for our foods, cakes, desserts , beverages and etc are non-refundable, non-returnable and non-exchangeable All sales are final and no cancellation will be allowed after payment is made. Your satisfaction is utmost important to us. We will thoroughly and wholly inspect our items before sending them out for delivery or to be collected by you to ensure that only good quality items are sent out or sold. We shall not accept any return and/or exchange of purchase items after the purchase items have left our premises either by a delivery specialist or by self-collect. In the event of change of address after an order has been made, you may be subject to additional delivery fees. In the event that a change of order has been accepted and cannot be fulfilled, we will replace your order with a similar product or another product with similar value. We may use the facial recognition payment systems for food redemption and other promotional activities from time to time.Cancellations
1.    The management reserves the right to cancel or refund any orders placed due to any unforeseen reason or circumstances that it deems fit.2.    Cancellation and/or Amendment is only allowed for pre-booking items which the delivery lead time is between 10 to 14 days. To cancel and/or amend your pre-booking items, you are required to notify us within 3 working days from the date you placed your order via our email at farcoffee-cs@delhubdigital.com If your request is accepted by FCSB, we will create and/or make the refund to you via issuance of our voucher.
Returns / Damaged Items / Refunds
(b) Address given was incorrect or insufficient.
(c) No such person at the given address.
(d) No valid contact number given for us to make reasonable attempts to contact the recipient in order to execute the delivery successfully.
(e) In the event of any non-delivery, no requests for refund will be entertained due to the perishable nature of our products.
(f) Refusal of any item by the recipient will still be considered as delivered and no refund will be made.

- To enforce our Terms and Conditions or any applicable end user license agreements;
- To protect personal safety and the rights, property or safety of others;
- To allow for audits and surveys to, among other things, validate the size and composition of our target audience, and understand their experience with the Site;

- To carry out due diligence or other screening activities (including, without limitation, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that may have been put in place by us;
- To audit our Site; to prevent or investigate any fraud, unlawful activity, omission or misconduct, whether relating to your use of the Site or any other matter arising from your relationship with us, and whether or not there is any suspicion of the aforementioned;
- Promotion activities;

1.    Personal Data means any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.2.    Personal During the course of your use of the Site and the provision of the Services, we may collect personal data from you, which includes but not limited to:

     7. Personal Profile - log in ID, username, log in password, purchases behaviour, your interests, preferences, feedback and survey          responses;
     8. Browsing Usage - frequency of visits, usage of the Site, contents of the Site that you visit or viewed;
     9. Check-in - location that you share or check-in with us, form of photographs or videos that you uploaded to the Site;
     10. Market Information - your preferences in receiving marketing information from us and our third parties and your communication          preferences.
